Terms and Conditions (Version 20260101)

Article 1. Definition

1.1 XclusiveMinerals is an independent organization specializing in jewelry, stones, crystals, and minerals. It is located in Dongen, the Netherlands, and forms part of Carlinde EV.

Article 2. Applicability

2.1 These General Terms and Conditions of Sale exclusively apply to all offers, orders, and agreements made with XclusiveMinerals.nl, excluding any other terms and conditions.
2.2 By accepting an offer or placing an order, the customer acknowledges and accepts these Terms.
2.3 Deviations from these Terms are only valid if published
2.4 All rights and claims stipulated for XclusiveMinerals.nl in these Terms or any additional agreements also apply to intermediaries and third parties engaged by XclusiveMinerals.nl.
2.5 All agreements with XclusiveMinerals.nl are governed by Dutch law. Any legal disputes shall be handled at the registered domicile of XclusiveMinerals.nl.

Article 3. Agreements

3.1 An agreement is established once XclusiveMinerals.nl accepts the customer’s order. The company reserves the right to refuse an order or request additional information. If an order is not accepted, the customer will be informed of the reason.

Article 4. Prices

4.1 All prices are listed in euros and include VAT at the applicable rate. Shipping costs are not included unless otherwise stated.
4.2 Shipping costs within the Netherlands depend on weight and are displayed during checkout. International shipping costs are available on request.
4.3 XclusiveMinerals.nl cannot be held to obviously incorrect prices due to typographical or system errors. No rights can be derived from such incorrect listings.

Article 5. Payments

5.1 Payment can be made using any of the methods presented during the order process. The customer will receive an order confirmation by email, including total costs (with shipping). Payment options include:
a.  Direct online payment (methods chosen by XclusiveMinerals.nl)
b. Any other methods indicated by XclusiveMinerals.nl

5.2 The customer authorizes XclusiveMinerals.nl to perform all actions necessary to process payment via the chosen method.
5.3 Any additional payment fees, where applicable, are displayed during checkout.

Article 6. Delivery

6.1 XclusiveMinerals.nl aims to deliver orders within 5 working days after receiving payment, though this is not guaranteed.
6.2 The customer receives an order confirmation and invoice, which must be checked for accuracy within 3 working days.
6.3 The maximum shipping time is 14 days unless the delay is outside the company’s control.
6.4 If delivery is delayed or items are out of stock, the customer will be notified within 7 days and may cancel the order free of charge.
6.5 Because all items are of natural origin, colors may differ per monitor or lighting conditions.
6.6 The attributed healing or spiritual properties of gemstones are complementary to official medicine. XclusiveMinerals.nl accepts no liability for claims regarding such effects.

Article 7. Retention of Ownership

Ownership of products transfers only after full payment for all amounts owed to XclusiveMinerals.nl under any agreement.

Article 8. Returns and Cancellations (Webshop)

Customers in the Netherlands may cancel their webshop purchase within 14 working days after receipt (entire order only), without penalty or reason.
To qualify for a refund:

  • Items must be complete, unused, undamaged, and returned (including original packaging) within 21 working days after delivery.
  • Return shipping costs are at the customer’s expense.
  • Unpaid or insufficiently stamped returns will not be accepted.
  • Items travel at the customer’s risk.

Refunds, including original shipping fees, are processed within 14 working days after receipt and inspection of the returned items.
Only one return right applies per order.
Partial refunds may be issued if the above conditions are not met, at the discretion of XclusiveMinerals.nl.

For complaints, customers should first email Info@XclusiveMinerals.nl. If unresolved, they can use the EU ODR platform at http://ec.europa.eu/odr.

Unless otherwise agreed, all shipments are at the customer’s risk. Registered shipping is available at the customer’s expense.

Article 9. Complaints

If an item fails to meet expectations, please contact us at Info@XclusiveMinerals.nl.

Article 10. Order Cancellations (Webshop)

10.1 Orders can be canceled within 12 hours of placement by email, provided the order has not been shipped.
If payment was already made, XclusiveMinerals.nl will refund the amount within 14 days to the original payment account. Any banking costs are borne by the customer.
10.5 Items are shipped only after full payment unless agreed otherwise.

Article 11. Auction Terms

Auctions follow the general terms above with the following additions:

  • All lots can be viewed beforehand at the location of XclusiveMinerals.nl in Dongen the Netherlands 
  • Bidding occurs only via the designated online platform and in whole euros (including VAT unless indicated).
  • Bids outside official auction times are invalid.
  • If the reserve price is not reached, the lot is not sold.
  • The highest valid bid constitutes a binding purchase.
  • Bids cannot be withdrawn.
  • Withdrawing a bid may result in exclusion from future auctions.
  • The highest bidder (meeting the reserve price) is considered the winner and must pay within 24 hours.
  • Failure to pay or respond within 24 hours may result in reassignment to the next bidder.
  • Auctioned items cannot be returned.
  • Shipping costs depend on weight and destination and are borne by the buyer.
  • Items are shipped only after full payment.
  • The management of XclusiveMinerals.nl decides in all matters not covered here.

Article 13. Force Majeure

In the event of force majeure, XclusiveMinerals.nl may suspend or terminate the agreement without court intervention. No compensation is owed unless this would be unreasonable in the given circumstances.

Article 14. Proper Use of Materials

The buyer must handle all tools and materials responsibly and professionally.
Minerals and crystals are not suitable for ingestion, injection, or making gemstone water, and should be kept out of children’s reach. Wash hands after handling.
XclusiveMinerals.nl is not liable for improper use. See each mineral’s Wikipedia page for toxicity details.

Article 16. Copyright & Intellectual Property

All content on this website—texts, photos, designs, trademarks, and other materials—is owned or licensed by XclusiveMinerals.nl and protected by copyright and related laws.
Reproduction, distribution, or copying in any form is prohibited without prior written permission.
The website content is provided with care but subject to possible errors or price changes.
XclusiveMinerals.nl is not liable for direct or indirect damage caused by or related to use of this information or linked websites.
The company reserves the right to modify the website at any time.
